Do people have a right to an explanation of AI decisions?

Yes, in several cases. Under Article 86 of the EU AI Act, a person affected by a decision based on an Annex III high-risk system that has legal or similarly significant effects can ask the deployer for a clear explanation of the AI's role and the main elements of the decision. GDPR also gives people rights around solely automated decisions, including meaningful information about the logic involved and the right to human intervention.

How it works

  1. Keep a record of what the AI decided, what it was given and why.
  2. Make sure a human can review and explain the outcome on request.
  3. Answer requests from the sealed record, so your explanation matches what actually happened.
