Does the EU AI Act apply to UK or US companies?

Yes, if they place an AI system or general-purpose AI model on the EU market, or if the output of their AI system is used in the EU. Article 2 applies the Act to providers and deployers outside the EU in those cases, much as GDPR reaches companies outside the EU that serve people in it.

How it works

  1. Selling or offering an AI product or service to customers in the EU brings you into scope as a provider.
  2. If you are outside the EU but your AI's output is used in the EU, you are in scope too.
  3. Providers of high-risk systems based outside the EU must appoint an authorised representative in the EU.
  4. Keep evidence of what your AI did for EU users: logs, oversight and decisions.
