Is using AI to screen CVs legal?
Yes, but it is regulated. Under the EU AI Act, AI used to recruit or select people, filter applications, evaluate candidates, or make decisions about promotion, termination or task allocation is high-risk (Annex III, point 4). That means human oversight, logging, transparency to candidates and, for providers, full high-risk compliance. In the UK and EU, GDPR applies to the personal data, and in New York City, Local Law 144 requires annual bias audits.
How it works
- Tell candidates that AI is used, and how.
- Keep a human in the loop for decisions that affect people.
- Test for bias regularly and record the results.
- Seal each screening decision so you can show what was decided and why.
