Checks / AI insurance readiness check
Insurance Act 2015 · EU AI Act Annex III · EIOPA 2025 · FCA

If your insurer doesn't know about your AI, your claim could be cut.

Under the Insurance Act 2015 you must make a fair presentation of the risk, and AI is now part of it. Fail to disclose it, breach a warranty about your controls, or find an AI exclusion in the small print, and a claim can be reduced or refused. Insurers using AI face their own rules: the EU AI Act makes life and health pricing AI high-risk, EIOPA set expectations in 2025 and the FCA bans price walking. Check where you stand in five minutes.

Insurance Act 2015 s.3
AI use disclosed to insurers in a fair presentation
Your broker and insurers told what AI you use, where and for what. Undisclosed AI risks a reduced or refused claim.

record kept of what was disclosed and when
A copy of what you disclosed at each renewal, with the date. Seal it so it can't be disputed later.
Insurance Act 2015 s.10
warranties about AI controls are being met
Any policy promise about controls (logging, human review, testing) actually kept, with evidence.
Insurance Act 2015 s.11
evidence links each AI control to the loss it guards against
For each AI control, the kind of loss it prevents, so a breach of an unrelated term can't sink a claim.

checked for AI exclusions and silent AI cover
Policy wording read for AI exclusions or gaps where cover is silent about AI.
Policy cover
cyber, PI and product liability policies cover AI losses
Written confirmation from your broker that cyber, professional indemnity and product liability cover AI losses.

Questions people ask

Do I have to tell my insurer I use AI?

Business insureds must make a fair presentation of the risk under the Insurance Act 2015, disclosing every material circumstance they know or ought to know. How a business uses AI can be material. If the presentation is unfair, the insurer's remedy depends on what it would have done had it known, from charging more to refusing the claim.

What happens if I breach a warranty about my AI controls?

Under the Insurance Act 2015 a breach of warranty suspends cover until it is remedied, rather than ending it. And under section 11, if a term is designed to reduce a particular kind of loss, the insurer cannot rely on its breach if you show the breach could not have increased the risk of the loss that happened. Evidence of your controls decides both.

Is AI used in insurance high-risk under the EU AI Act?

Yes, for AI used for risk assessment and pricing of natural persons in life and health insurance (Annex III, point 5(c)). Those systems must meet the high-risk requirements, including logging and human oversight.

What does EIOPA expect of insurers using AI?

EIOPA's Opinion on AI governance and risk management (August 2025) explains how existing insurance law applies to AI not classed as high-risk: data governance, record-keeping, fairness, cyber security, explainability and human oversight, applied in proportion to the risk.

Can my insurer refuse an AI-related claim?

It depends on your disclosure, your warranties and the policy wording. Many policies are silent about AI. A sealed record of what you disclosed and what your AI did is the strongest position to argue from.
