MODEL POLICY WORDING

Live AI Risk Control Condition

Wording an insurer can put in an AI policy so cover depends on live, provable behaviour. Cover is suspended while the AI is below the required level and comes back when it's restored. Every moment can be checked against the sealed record.

1. Definitions

"Insured AI System" means the artificial intelligence system or systems named in the Schedule.

"Evidence Record" means the sealed, timestamped record of the Insured AI System's operation kept by sebbi.pro, including its hash chain, receipt sequence and Bitcoin timestamps, as published at https://sebbi.pro/insurer-feed.

"Live Insurability Level" means the level (I-0 to I-4) shown for the Insured AI System by the Evidence Record, worked out under the published rules at https://sebbi.pro/.well-known/insurer-feed.json in force on the date this policy incepts.

"Required Level" means Live Insurability Level I-[3] or such other level stated in the Schedule.

"Period of Non-Compliance" means any period during which the Evidence Record shows the Insured AI System below the Required Level.

2. Risk control condition

The Insured shall maintain the Insured AI System at or above the Required Level throughout the Period of Insurance.

3. Suspension, not termination

If there is a Period of Non-Compliance, the Insurer shall have no liability under this Section for any loss which occurs, or which is attributable to something happening, during that Period of Non-Compliance.

Cover is suspended only for that period. It resumes from the time the Evidence Record shows the Insured AI System at or above the Required Level again.

4. Relevance of non-compliance

The Insurer may not rely on clause 3 to exclude, limit or discharge its liability for a loss if the Insured shows that the non-compliance could not have increased the risk of the loss which actually occurred in the circumstances in which it occurred.

5. Evidence

The Insurer and the Insured agree that the Evidence Record may be relied on as evidence of the Live Insurability Level at any time, and of the operation of the Insured AI System. Either party may verify it independently without reference to the other or to sebbi.pro.

Nothing in this clause prevents either party from relying on other evidence.

6. Sharing

The Insured shall share the Live Insurability Level of the Insured AI System with the Insurer through the sebbi.pro Insurer Feed for the Period of Insurance, and shall not withdraw that sharing without notice to the Insurer.

A withdrawal of sharing is not of itself a Period of Non-Compliance.

Notes

Draft model wording for commercial (non-consumer) insurance under English law. It is not legal advice and must be reviewed by the insurer's own lawyers before use.

Written to sit within the Insurance Act 2015: section 10 (a breach suspends cover, which resumes once remedied) and section 11 (terms not relevant to the actual loss).

If adapted to put the insured in a worse position than the Act's default rules, the transparency requirements of section 17 apply: the term must be drawn to the insured's attention and be clear and unambiguous.

Other jurisdictions have different rules on conditions and warranties.

Returns MET, NOT_MET or UNKNOWN with the level in force at that second, containment and kill-switch state, any missing receipts around that moment and the facts of the loss decision. The answer is sealed.
